These Terms of Service (“Terms”) govern your use of the Freewill Web Design LLC website and any services provided by Freewill Web Design LLC (“Freewill Web,” “we,” “us,” or “our”). By contacting us, submitting a project inquiry, signing a proposal, or working with us, you agree to these Terms.

Scope of Services

Services may include, but are not limited to:

  • Custom website design and development

  • Website redesigns

  • Conversion-focused page layouts

  • Client support related to completed projects

All services are defined and agreed upon in writing (proposal, invoice, or agreement) before work begins.

Project Proposals & Agreements

All projects require a written agreement, proposal, or invoice outlining:

  • Scope of work

  • Timeline

  • Deliverables

  • Payment terms

Any work outside the agreed scope may require a separate agreement or additional fees.

VIP Web Design Days

VIP Web Design Days are time-based services reserved exclusively for a client on a scheduled date.

  • VIP Days must be paid in full prior to the scheduled date

  • Missed or rescheduled VIP Days may be subject to rescheduling fees or forfeiture

  • Results depend on scope, preparation, and availability of materials

VIP Days prioritize focused progress but do not guarantee completion of all requested work.

Client Responsibilities

To ensure timely and successful completion of services, clients agree to:

  • Provide accurate and complete information

  • Supply required content, assets, and feedback in a timely manner

  • Respond to communications within a reasonable timeframe

Delays caused by the client may impact timelines and delivery dates.

Payments & Billing

Payment Methods

We accept payment via:

  • Stripe invoices

  • Cash

  • Check

We do not store credit card or banking information.

Payment Structure

Unless otherwise stated in writing:

  • A deposit is required before work begins

  • Remaining balances are due according to agreed milestones

  • VIP Web Design Days require full payment upfront

Invoices must be paid by the due date listed.

Late Payments

Late or unpaid invoices may result in:

  • Paused work

  • Delayed delivery

  • Temporary suspension of services

Accounts with outstanding balances may not receive continued support until payment is resolved.

Cancellations & Refunds

Project-Based Work

Deposits are generally non-refundable once work has begun. Refunds, if any, are handled on a case-by-case basis and at our discretion.

VIP Web Design Days

VIP Days are reserved time and are non-refundable once scheduled. Rescheduling requests must be made in advance and are subject to availability.

Intellectual Property

Client Ownership

Upon full payment:

  • Clients receive rights to the final website deliverables

  • Ownership includes custom design and site content created specifically for the client

Third-Party Tools

Websites may include third-party software, plugins, fonts, or services that are subject to their own licenses and terms.

Clients are responsible for ongoing licenses unless otherwise agreed in writing.

Portfolio Use

Unless otherwise agreed in writing, Freewill Web Design LLC reserves the right to:

  • Display completed projects in portfolios

  • Reference work for promotional purposes

No confidential or sensitive client information will be disclosed.

Client Accounts & Support

Some clients may be provided with private user accounts to submit support requests.

  • Accounts are created and issued by Freewill Web

  • Clients are responsible for keeping login credentials secure

  • Access may be revoked upon project completion or termination

Confidentiality & NDAs

We respect client confidentiality.

  • Confidential information shared during a project will not be disclosed without permission

  • Non-Disclosure Agreements (NDAs) may be executed when required

  • NDAs take precedence over conflicting terms in this document

Disclaimer of Guarantees

While we design websites using best practices for usability, performance, and SEO structure:

  • We do not guarantee specific rankings, traffic, leads, or revenue

  • Website performance depends on many factors outside our control

Limitation of Liability

To the fullest extent permitted by law:

  • Freewill Web Design LLC is not liable for indirect, incidental, or consequential damages

  • Total liability shall not exceed the amount paid for the services giving rise to the claim

Website Availability

We strive to keep our website available but do not guarantee uninterrupted access. Temporary downtime may occur for maintenance, updates, or technical issues.

Termination

We reserve the right to decline or terminate services if:

  • Terms are violated

  • Payment obligations are not met

  • Communication becomes abusive or unreasonable

Termination does not waive payment obligations for completed or in-progress work.

Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles.

Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised effective date.
